OVERVIEW
Welcome to MyTinySecret.
The terms “we”, “us” and “our” refer to MyTinySecret. We operate this website and online store, including the information, content, features, products and services made available through it (the “Services”).
Our online store is powered by Shopify.
These Terms of Service, together with any policies referenced within them, explain the terms on which you may access our Services and purchase products from us.
Please read these Terms carefully before using our website or placing an order.
By accessing or using the Services, you agree to these Terms and our Privacy Policy.
Nothing in these Terms limits or excludes any rights that cannot legally be excluded under applicable consumer law.
SECTION 1 — USING OUR SERVICES
You must use our Services only for lawful purposes.
When creating an account, placing an order or otherwise providing information to us, you agree that the information you supply is accurate, current and complete.
You are responsible for maintaining the security of your account credentials and for activity carried out through your account.
You must not transfer, sell or provide your account to another person in a way that compromises the security or integrity of the Services.
We may reasonably restrict or suspend access to the Services where necessary to protect MyTinySecret, our customers, our systems or other users.
SECTION 2 — OUR PRODUCTS
We make reasonable efforts to display product descriptions, photographs, colours, dimensions and other product information accurately.
However, colours and appearance may vary slightly depending on your device, screen settings, lighting and normal manufacturing tolerances.
This does not affect your legal rights where a product is faulty, damaged, not as described, of unsatisfactory quality or otherwise fails to meet applicable consumer-law requirements.
Product descriptions, collections, availability and specifications may change from time to time.
We may discontinue products or reasonably limit the quantity of products available to a particular customer, destination or geographic region.
SECTION 3 — ORDERS
When you submit an order, you are making an offer to purchase the products contained in that order.
Receiving an automated order acknowledgement does not necessarily mean that we have accepted your order.
A contract is formed when we confirm acceptance of your order or otherwise begin fulfilment, subject to applicable law.
We may decline or cancel an order where reasonably necessary, including where:
• a product is unavailable;
• payment cannot be authorised;
• product or pricing information contains a genuine error;
• we reasonably suspect fraud or misuse;
• we reasonably suspect purchasing for unauthorised commercial resale;
• we cannot deliver to the destination or address supplied; or
• fulfilling the order would breach applicable law or carrier restrictions.
If we cancel an order after taking payment, we will refund the affected amount.
Please review your order carefully before submitting it.
Once an order has entered fulfilment, we may no longer be able to change or cancel it.
Returns, cancellations and refunds are governed by our Return and Refund Policy together with any statutory rights that apply to you.
SECTION 4 — PRICES AND PAYMENT
Product prices are displayed in the currency shown on the website.
Prices shown to consumers include applicable taxes where required by law.
Delivery charges and other mandatory charges that can be calculated in advance will be shown before you complete your purchase.
International orders may be subject to customs procedures, import duties, local taxes or other charges depending on the destination.
Where MyTinySecret collects applicable duties or taxes at checkout, this will be shown during checkout.
Where such charges are not collected by us, the recipient may be responsible for charges imposed by the destination country.

Prices, promotions and discounts may change from time to time.
Changes will not normally alter the price of an order we have already accepted, except where permitted by law to correct a genuine and obvious error.
You agree to provide accurate payment and billing information and confirm that you are authorised to use the payment method submitted.
SECTION 5 — SHIPPING AND DELIVERY
Shipping destinations, shipping charges and estimated delivery information are displayed through our website or checkout where available.
MyTinySecret operates across different product categories and fulfilment locations.
Orders containing more than one product may therefore arrive in separate packages or on different days.
Delivery times are estimates unless expressly stated to be guaranteed.
For UK consumer purchases, risk of loss or damage generally remains with MyTinySecret until you, or a person identified by you to receive the goods, takes physical possession of them.
Different rules may apply where you independently arrange a carrier that was not offered by us.

SECTION 6 — RETURNS, CANCELLATIONS AND REFUNDS
MyTinySecret offers a voluntary 30-day return period subject to the eligibility requirements stated in our Return and Refund Policy.
Your statutory cancellation rights may operate separately from our voluntary 30-day policy.
Nothing in these Terms affects your legal rights in relation to products that are faulty, damaged, unsafe, incorrectly supplied or not as described.
Certain sealed beauty or personal-care products may not be eligible for change-of-mind returns once their hygiene or protective seal has been broken where the applicable health or hygiene exception applies.

SECTION 7 — INTELLECTUAL PROPERTY
The MyTinySecret website and its content, including our branding, logos, artwork, photographs, graphics, copy, video, product presentation, layouts, designs and other materials, are owned by or licensed to MyTinySecret unless otherwise stated.
These materials may be protected by copyright, trademark, design and other intellectual-property laws in the United Kingdom and other jurisdictions.
You may access and use the website for your personal and non-commercial use.
You must not reproduce, distribute, commercially exploit, republish, modify or create unauthorised derivative works from protected MyTinySecret material without our permission, except where permitted by law.
MyTinySecret names, logos, product identities, designs and other brand elements must not be used in a way that falsely suggests endorsement, affiliation, sponsorship or authorisation.
SECTION 8 — THIRD-PARTY SERVICES AND LINKS
Our Services may contain links to, integrations with or functionality provided by independent third parties.
We are not responsible for the content, availability or practices of independent third-party websites or services.
Where you choose to access or use an independent third-party service, its own terms and privacy practices may apply.
Nothing in this section limits any responsibility that cannot legally be excluded.
SECTION 9 — SHOPIFY
Our online store is powered by Shopify, which provides ecommerce infrastructure used to operate the store.
Purchases made through the MyTinySecret store are made with MyTinySecret.
Shopify is not the seller of MyTinySecret products.
Certain information may be processed by Shopify as necessary to operate the store, process transactions and provide related functionality.
SECTION 10 — PRIVACY
Personal information collected through our Services is handled in accordance with our Privacy Policy.
Our ecommerce infrastructure is provided by Shopify, and certain information may also be processed by Shopify and other service providers necessary to operate our Services, fulfil orders, process payments, prevent fraud and provide customer support.

SECTION 11 — FEEDBACK, REVIEWS AND USER CONTENT
If you voluntarily submit reviews, photographs, comments, suggestions or other content to us, you confirm that you have the right to submit that material.
Where you expressly provide content for publication, promotional use or other use by MyTinySecret, you grant MyTinySecret a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for the purposes for which it was submitted, subject to applicable law and any separate agreement between you and MyTinySecret.
You must not submit content that:
• infringes another person’s intellectual-property, privacy or other rights;
• is unlawful or fraudulent;
• contains malicious software;
• impersonates another person;
• is defamatory or deliberately misleading; or
• otherwise violates applicable law.
You remain responsible for content you submit.
SECTION 12 — ERRORS, INACCURACIES AND AVAILABILITY
Occasionally the Services may contain typographical errors, inaccuracies or outdated information relating to product descriptions, pricing, promotions, shipping information, transit times or availability.
We may correct genuine errors and update information when necessary.
Where an error affects an order that has already been placed, we will act reasonably and in accordance with applicable consumer law.
If we cannot fulfil an accepted order because a product is unavailable, we will provide an appropriate refund for the affected product.
SECTION 13 — PROHIBITED USES
You must not use our Services:
• for unlawful, fraudulent or malicious purposes;
• to infringe another person’s intellectual-property or privacy rights;
• to transmit viruses, malware or malicious code;
• to interfere with the security or operation of the Services;
• to impersonate another person or organisation;

We aim to keep the Services available and functioning correctly.
However, we do not guarantee that access will always be uninterrupted or error-free.
We may temporarily suspend or restrict parts of the Services for maintenance, security, technical reasons, updates or circumstances outside our reasonable control.
We will take reasonable steps to minimise disruption where appropriate.
SECTION 15 — LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms excludes or restricts liability for:
• death or personal injury caused by negligence where liability cannot legally be excluded;
• fraud or fraudulent misrepresentation;
• defective products where liability cannot legally be excluded;
• breach of statutory consumer rights that cannot legally be excluded or restricted; or
• any other liability which the law does not permit us to exclude.
If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed, except where applicable law provides otherwise.
Nothing in these Terms excludes any remedy available to you under applicable consumer law.
SECTION 16 — EVENTS OUTSIDE OUR REASONABLE CONTROL
We are not responsible for a failure or delay caused by circumstances outside our reasonable control where the law permits this.
Such circumstances may include major carrier disruption, customs disruption, natural disasters, widespread technical failures, industrial action, government restrictions or similar events outside our reasonable control.
Where such circumstances materially affect an order, we will take reasonable steps to minimise the impact.
Any cancellation, refund or other rights provided to you by applicable law remain unaffected.
SECTION 17 — TERMINATION
You may stop using the Services at any time.
We may suspend or terminate access to the Services where reasonably necessary, including where these Terms have been materially breached, unlawful activity is suspected or continued access creates a security risk.
Termination does not affect rights or obligations that arose before termination.
Sections which by their nature should continue after termination, including intellectual-property provisions and liability provisions, will continue where appropriate.
SECTION 18 — SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.
The remaining provisions will continue in effect.
SECTION 19 — WAIVER
If we do not immediately enforce a right or provision under these Terms, this does not mean that we have waived that right.
A waiver on one occasion does not automatically constitute a waiver on another occasion.
SECTION 20 — TRANSFER
We may transfer our rights and obligations under these Terms as part of a legitimate restructuring, sale or transfer of our business, provided doing so does not reduce your rights under the contract.
If you are a consumer, you may transfer your contractual rights where permitted by law or with our agreement.
SECTION 21 — GOVERNING LAW
These Terms and contracts entered into through our UK store are governed by the laws of England and Wales.
If you are a consumer residing elsewhere, this choice of law does not deprive you of mandatory consumer protections that apply to you under the law of your country of residence.
Nothing in these Terms prevents a consumer from bringing proceedings in a court where applicable consumer law gives them the right to do so.
SECTION 22 — CHANGES TO THESE TERMS
We may update these Terms from time to time.
The version applying to a purchase will generally be the version that was in effect when the relevant order was placed.
Where a change materially affects an ongoing Service, we will provide notice where required by applicable law.
The most current version of these Terms will be available through our store.
SECTION 23 — THE MYTINYSECRET APP AND DIGITAL SERVICES
These Terms primarily govern the MyTinySecret online store and purchases made through it.
Separate or additional terms may apply to the MyTinySecret App, accounts, community functionality, digital products, technology products or other interactive features.
Where separate terms are required, they will be made available through the relevant service.
SECTION 24 — ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy and any other terms expressly incorporated into a transaction, form the agreement governing your use of the relevant Services.
If a provision in these Terms conflicts with a mandatory right provided to you by law, the mandatory legal right will take priority.
